Construction insurance: protection for materials, people and progress
Classical construction insurance only covers material damage to your own construction project, but not damage caused to third parties. This is the responsibility of builder's liability insurance. Whether construction site visitors, passers-by or tradespeople involved - the right policy counts in the event of damage. Important to know: The liability insurance of the contracted construction company is not enough, as the client is also responsible for all liability claims that may arise from the construction work. Natural hazards such as storm damage or fires as well as damage caused by third parties often remain uninsured. Construction insurance, on the other hand, offers comprehensive protection – including fully comprehensive cover with a few exclusions. Construction work that has already begun requires a certificate from the site manager. The sum insured is based on the estimated construction costs (net).
Builder's liability: When responsibility becomes important
According to Spanish construction law, the builder is liable for all liability claims that arise in the course of the construction work. An example: A temporary construction fence falls over and seriously injures a person passing by. Even if the work has not yet begun, the client and construction company share liability. Builder's liability insurance covers these risks. It must be taken out before the start of the construction phase and offers sums insured of between 150,000 and 3 million euros, depending on the size of the project and the risk analysis. Anybody who builds a new property or structurally expands an existing property and then wants to sell it is legally obliged to take out Seguro Decenal insurance. This construction quality insurance insures the buyer for ten years
against structural damage that could impair the stability of the building and, in the worst case, make a new build or conversion uninhabitable. The contract requires the technical supervision of the project by an authorized OCT (Organismo de Control Técnico). AXA only works with certain OCTs – prior consultation is essential here.
The insurance premium is paid in two stages: 30% before the start of construction with the creation of a preliminary contract, 70% upon acceptance of the construction. The premium calculation is based on the total costs including architects' fees, license fees and VAT.
